Terms and Conditions
This Contract outlines the terms and conditions for the provision of Services to the Customer by Scallywag Ventures Pty Ltd, trading as Dreamtime Teepees, ABN 32 624 375 471, (hereinafter referred to as “Dreamtime Teepees”). The hired items are those stated in the contract (hereinafter referred to as the “Equipment”). The Customer is the person taking the Equipment on hire. The Contract is the Booking Form Agreement between Dreamtime Teepees and the Customer. By accepting this Contract the Customer agrees to be bound by these terms and conditions. The Contract will come into effect between the Customer and Dreamtime Teepees when the Customer submits the booking form and pays the deposit.
1.DEPOSIT:
(i) A $100 non-refundable deposit will be required at time of booking to hold your party date.
(ii) No party date will be confirmed until the deposit is received. This deposit will be deducted from the final balance.
2. PAYMENT:
(i) Payment must be paid in full two weeks before the date of the party by Electronic Funds Transfer. Dreamtime Teepees reserves the right to cancel your booking if the full balance is not settled 14 days prior to your party date.
(ii) A minimum booking fee of $425 applies to all bookings. The remaining balance is based upon final headcount and additional items. At the time of payment, numbers, theme and any extras will be confirmed. After this time changes cannot be made and no refunds will be possible.
3. CANCELLATION OR RESCHEDULE:
(i) Cancellations can be made up to 21 days prior to the party. The $100 deposit is non-refundable, but it can be applied towards the cost of another party if held within 90 days of the original party date. Only one date reschedule will be permitted per booking.
(ii) For bookings cancelled within 14 days of the party, Dreamtime Teepees will charge the Customer 50% of the total package price. There will be no refunds given for any cancellations 3 days before the event.
(iii) Dreamtime Teepees reserves the right to cancel your party booking at any time, for any reason. Upon any such cancellation Dreamtime Teepees will refund the Customer any monies paid in respect of the party booking, within 30 days, should any refund be due. Dreamtime Teepees will not be liable to pay any compensation to the Customer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation.
4. THEME VARIATIONS:
(i) The Customer understands that the teepee canvas colours and accessories for the Customer’s selected theme may be different to those depicted the photographs on the website or social media due to upgrading of accessories and stock.
5. SET UP:
(i) Dreamtime Teepees will set up on a Friday and pack down on a Monday unless otherwise agreed. Dreamtime Teepees will provide the Customer with a two hour window for arrival.
(ii) It is the Customer’s responsibility to ensure there is a responsible adult present during delivery, set up and collection and to ensure that parking is made available. The Customer should allow up to 90 minutes for set up and up 90 minutes for pack down. Alternate times can be discussed on request and are subject to availability.
(iii) The Customer hereby authorises Dreamtime Teepees to enter upon the Customer’s premises, so as to inspect, test, repair, replace or repossess the same.
6. SPACE:
(i) It is the Customer’s responsibility to ensure there is enough space to accommodate the teepees and that all furniture is moved out the way and the area is clean. Dreamtime Teepees will not be responsible for moving furniture as part of the set up.
(ii) Each teepee requires a minimum space of 1.8m length and 1m width. For Teepees facing each other a minimum length required is 4.1m to accommodate 2 teepees facing.
(iii) Dreamtime Teepees will not be liable for any damage to the Customer’s home caused by the equipment. This includes damage to the site, site access, furniture and personal belongings.
7. HIRE PERIOD:
(i) The equipment is available for hire for a 24 hour period unless specified otherwise. If the equipment is unavailable collection on the agreed date, Dreamtime Teepees reserves the right to charge the Customer as per the 24 hour rate.
8. EQUIPMENT HIRE OBLIGATIONS:
(i) The Customer’s responsibility for the Equipment commences on the receipt of the Equipment by Dreamtime Teepees, and ends when the Dreamtime Teepees collects the Equipment.
(ii) A checklist with the Equipment will be provided to the Customer on set up. It is the Customer’s responsibility to check the quantity and condition of hired items upon set up and advise Dreamtime Teepees immediately of any discrepancy or damage. The Customer accepts full responsibility for the care and safekeeping and return in good order of the Equipment. Any damaged or lost items will be charged to the Customer at replacement value.
(iii) Under no circumstances shall the Customer repair or attempt to repair the Equipment unless authorised by the Dreamtime Teepees. Dreamtime Teepees reserves the right to repair or replace the faulty equipment as soon as is practically possible during the hire period. Dreamtime Teepees will not be liable for any loss, damage or expenditure incurred by the Hirer due to faulty equipment.
(iv) Dreamtime Teepees shall not be liable for any consequential loss to the Customer, including any expenses, liability, loss, claim, or proceeding whatsoever caused by, or arising out of, the late delivery, non delivery, unsuitability, or lawful repossession of the Equipment or any part thereof, or any breakdown or stoppage of same.
(v) The set-up and take down of equipment must only be performed by a member of Dreamtime Teepees team. Teepees are not suitable for outside use and are for indoor use only. The teepees must not be moved to another location after set up.
(vi) No smoking is allowed near the Equipment at any time.
(vii) Shoes must be removed before using the Equipment. No facepaint, nailpolish, food or drinks are to be used on or near the teepees. No candles or naked flames are to be used near the teepees and pets should be kept away from the Equipment at all times. Any stains caused by pets, drinks or food inside or outside the teepees or any Equipment will result in a cleaning fee of $100. Nailpolish, food and drinks are only allowed on the pamper station or grazing station.
(viii) A cleaning fee of $100 will be applied to all equipment returned excessively dirty. Linen does not need to be washed, however if returned stained or excessively dirty, a cleaning fee will apply.
9. INJURY AND SUPERVISION:
(i) It is responsibility of the Customer to take duty of care and supervise children with the Equipment. Teepees are recommended for children over the age of 5, however children should be supervised at all the times.
(ii) Dreamtime Teepees are not responsible for the welfare of the children at the parties, which remains the full responsibility of the Customer.
(iii) The Customer accepts all liability when renting from Dreamtime Teepees. All persons using the Equipment do so at their own risk. Dreamtime Teepees assumes no responsibility or liability for accidents, personal injury, death, loss or damage to property or any person or persons that occur during the rental period, unless it is proved that such injury was caused by faulty material, workmanship or negligence on the part of Dreamtime Teepees. The Customer will be fully responsible/liable for any damage or injury occurring from or as a result of accident, misuse, neglect or reckless use of such Equipment hired.
(iv) Dreamtime Teepees is not responsible for allergic reactions and/or any medical reactions from wearing costumes, make up/nails products, facial masks or any activity taking place during the Equipment hire period. The Customer will be responsible for any allergies of guests attending the party.
(v) The Customer shall at all times and in all respects indemnify Dreamtime Teepees against and from any and every expenses, liability, financial loss, claim or proceedings whatsoever in respect of any personal injury whatsoever and in respect of damage to or loss of any property whatsoever, arising out of or in connection with or consequent upon the hire, delivery, use, misuse, non-use, repossession, collection, return or non return of the equipment or any part thereof. This clause shall not apply where the expenses, liability, financial loss or claim or proceeding or damage or loss of any property aforesaid results from the breach of Contract or the negligence of the Dreamtime Teepees.
(vi) It is the responsibility of the Customer to have the appropriate insurance in place during the rental period.
10. PROMOTIONAL MATERIALS:
(i) Dreamtime Teepees reserve the right to use photography taken at during the hire period in any promotional media. The Customer will make no monetary or other claim against Dreamtime Teepees for the use of photographs taken. Dreamtime Teepees will never use identifying information in images and no images of children will be used without the Customer’s consent.
